Formation of the contract

1.1. These terms of sale apply to all goods supplied by GB Kent & Sons PLC, registered in England and Wales at London Road, Apsley, Hemel Hempstead, HP3 9SS, company number is 00066471 (“GB Kent”).

1.2. No contract exists between you and GB Kent for the sale of any goods until GB Kent has received and accepted your order and has sent you confirmation in writing or by email to the address or email address you have given. Once GB Kent does so, there is a binding legal contract between us.  Please note that in addition to any other right GB Kent may have to decline your order, eg when the item is out of stock or otherwise unavailable, GB Kent may in its sole discretion, decline your order when it believes on reasonable grounds that you are a trader, or your purchase is likely to lead to infringement of GB Kent’s rights by for example, the onward supply of our products to third parties outside the United Kingdom.  If you are a trader, please follow this link to apply for a trade account.

1.3. The contract is subject to your right of cancellation in certain cases (see below).

1.4. GB Kent may change these terms of sale without notice to you in relation to future sales.

Description and price of the goods

2.1.The descriptions and price of the goods you order will be as shown in GB Kent’s current catalogue and on its website at the time you place your order.

2.2. The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, GB Kent will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.3. Every effort is made to ensure that prices shown in GB Kent’s current catalogue or shown on its website are accurate at the time you place your order. If an error is found, GB Kent will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, GB Kent will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.4. In addition to the price, you may be required to pay a delivery charge for the goods, as shown in the section of GB Kent’s catalogue or website about delivery.

2.5. The price of the goods and delivery charges are inclusive of VAT where due.

3.1. Payment for the goods and delivery charges can be made by any method shown in GB Kent’s current catalogue or shown on its website at the time you place your order.

3.2. Black Friday Promotion:  The promotional code entitles the customer to 33% off a single transaction with the ranges on promotion. This offer is valid between 9am on Friday 24th November 2017 and 23:59 Monday 27th November 2017. The promotion is valid on all products. This offer cannot be redeemed in conjunction with any other promotion or offer whatsoever. 3.6. May Bank Holiday Promotion: The promotional code entitles the customer to 15% off a single transaction with the brushes on promotion. This offer is valid between 00:01am on Friday 25th May 2018 and 11:59pm Monday 28th May 2018. This offer cannot be redeemed in conjunction with any other promotion or offer whatsoever. 3.7. Fathers Day Promotion: The promotional code entitles the customer to 15% off a single transaction with the brushes on promotion. This offer is valid between 00:01am on Friday 8th June 2018 and 12noon Friday 15th June 2018. The promotion is valid only on certain  brushes which are listed on the https://kentbrushes.com/fathers-day promotion page. This offer cannot be redeemed in conjunction with any other promotion or offer whatsoever. The promotional code must be registered at the time of purchase, by using the ‘voucher code’ field on the Shopping Basket page. This offer may only be used once for one online transaction. Delivery

4.1. The goods you order will be delivered to the address you give when you place your order.

4.2. If delivery cannot be made to your address, GB Kent will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.

4.3. If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.

4.4. Every effort will be made to deliver the goods without undue delay, and in any event within 30 days of the date on which the contract is entered into. However, GB Kent will not be liable for any delay in delivery caused by circumstances beyond GB Kent’s reasonable control. n this case, GB Kent will inform you as soon as possible.

4.5. You will become the owner of the goods you ordered and responsible for risk of loss of or damage to them once they have been delivered to you.

4.6. In addition to the price, you may be required to pay a delivery charge for the goods, as shown in the section of GB Kent’s catalogue or website concerning delivery. If you order goods from our site or over the telephone for delivery to an address outside the UK, EU or EEA, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order. In the event of cancellation you will be responsible for recovering any such charges.

Your right of cancellation

5.1. In certain cases you have a right to cancel the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

5.2. You do not have the right to cancel the contract if the order is for the supply of certain goods, including goods that are made to your specifications or are clearly personalised, goods that are liable to deteriorate or expire rapidly and sealed goods not suitable for return for health protection or hygiene reasons.

5.3. GB Kent will inform you prior to the contract coming into force if you have a right of cancellation, and if so the conditions, time limit and procedures for exercising it.

5.4. Where you have the right to cancel the contract, you must normally do so within 14 days after the goods come into your physical possession.

5.5. To exercise your right of cancellation, you must inform GB Kent by post, fax or email, at the address, fax number or email address shown below, giving details of the goods ordered and (where appropriate) their delivery.

5.6. If you exercise your rights of cancellation after the goods have been delivered to you, you will have to bear the cost of returning the goods to GB Kent. The goods must be returned to the address show below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.

5.7. Once you have informed GB Kent that you are cancelling the contract, GB Kent will refund or re-credit you within 14 days for any sum that has been paid by you or debited from your credit card for the goods.

5.8. If you do not return the goods as required, GB Kent may charge you a sum not exceeding the direct costs of recovering the goods.

Warranty/Guarantee

6.1. All products purchased by consumers from GB Kent & Sons PLC t/a Kent Brushes (‘us/our’) either directly from us or from our authorised distributors and resellers including retail and web-based sellers, are warranted free from manufacturing defects for 12 months from the date of supply.

6.2. Kent Brushes’ warranty does not extend to products supplied/sold by unauthorised vendors, either bricks and mortar or web-based.

6.3. This warranty does not apply to any defects in our products arising from fair wear and tear, damage by you, use otherwise than as recommended by us, failure to follow our instructions, or any alteration or repair carried without our approval.

6.4. If the product develops a defect while under warranty, or you have any other complaint about the goods, you should notify us in writing at the address or email address shown below.

6.5. For details of our after sales assistance and/or our complaints handling policy please contact our customer service department.

6.6. This warranty does not affect your statutory rights as a consumer.

Data Protection

7.1. GB Kent will take all reasonable precautions to keep the details of your order and payment secure, but unless GB Kent is negligent, GB Kent will not be liable for unauthorised access to information supplied by you.

7.2. GB Kent will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise. GB Kent would like to notify you of products and offers that may be of interest to you from time to time, and if you would like to be notified of these, please tick the box below. You can correct any information about you by editing your account details online, or ask for information about you to be deleted by unsubscribing by ticking the box below.

Applicable Law

These terms of sale and the supply of the goods will be subject to English Law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.

Shipping & Delivery

Shipping & Delivery

All orders are usually despatched on the same working day if the order is placed before 9am. After this time, your order will be despatched on the following day. This excludes weekends and all Public UK Holidays.

If the order is placed after 9am Friday morning, your order will be despatched from our warehouse on the following Monday.

UK Mainland Prices and & Delivery Times:

All UK mainland orders will be despatched Free Delivery.

Despatched via Royal Mail First Class Post. Estimated arrival time is usually 1-2 working days from date of despatch.

Overseas Orders Prices and & Delivery Times:

Overseas orders are despatched via Air Mail, meaning the orders will not be despatched with a tracking number.

  • Value of Order: £0 – £49.99 | Europe: £2.00 | Rest of World: £5.50
  • Value of Order: £50- £99.99 | Europe: £3.50 | Rest of World: £8.50
  • Value of Order: Over £100  | Europe: £6.00 | Rest of World: £10.50

An overseas delivery can take 5-20 working days to arrive depending on if the order is held at customs. If this is the case, the delivery can take longer than the 20 working days.

Please note: if the delivery address is incorrect at the time of despatch, the order will not arrive to the destination and will be sent back to us which will result in a longer delivery time.

If we have a problem delivering your order we will advise you.

Under the UK Data Protection Act 1998, we follow strict security procedures in the storage and disclosure of information which you’ve given us. When you make an online order, we need to know your name, email address, credit card billing address, delivery address, credit or debit card number and associated details. This allows us to process and fulfil your orders and to notify you about your order status. We also require a landline telephone number in case we need to contact you, and for international orders this number may be given to our couriers in order to help with the delivery of your goods.

You have trusted us by giving us these details and we promise not to use these details for any other reason other than processing your order or informing you about the products and services of G.B Kent & Sons Plc. We will not pass any of your details on to third parties for profit or otherwise. Our security procedures mean that we may occasionally request you to answer security questions or provide proof of identity before we are able to disclose sensitive information to you.

Returns & Replacements

Returns & replacements are free and simple. We all make mistakes, we may have sent you the wrong product or you may have chosen the wrong brush. The most important thing is to let us know immediately. Please either call our customer help line on 01442 232623 or email us on kalie@kentbrushes.com.

Making a purchase could not be easier. Just browse our Catalogue, and click on “add to cart” for items that you wish to buy. After you have finished your selection, click on “Checkout” and you will be asked for a few details that we need to be able to satisfy the order, such as your name, delivery address, e-mail or phone number.

We accept credit card payment. If you are shopping from outside of the UK, place your order and your credit card company will convert the transaction to your own currency.

We accept Switch/Maestro, Visa and MasterCard. We do not charge for any item until it is ready to ship.

Back ordered items are not charged until they are shipped. You may send your credit card information via phone, fax or over the Internet.

Kent reserve the right to withdraw competitions, promotions and discount offer codes at any time.

Where do I add a promotional code?

The promotional code must be registered at the time of purchase by entering the code into the “Voucher Code” box on the shopping basket page.

Your basket contents and value will be re-calculated to account for your promotion. The promotional code can only be used for one order.

The promotional code cannot be exchanged for cash. The promotional code cannot be used in conjunction with any other offer. The promotional code cannot be used in conjunction with any other offer discount or promotion unless otherwise stated. Invalid, duplicate or expired voucher codes will not be accepted.

Can I use two promotional codes together?

Unfortunately you are not able to use two promotional codes together. Sorry about that – so you’ll need to decide which promotion code you’d like to use if you have more than 1 to choose from.

How do I know my promotion code has been applied to my order?

Once you have entered your promotional code into the “Voucher Code” on the Shopping Basket page, you will see a message that the code has been applied and you will see the discount applied to the subtotal.

Why is my promotional code not working?

If you are having trouble with a promotion code, please check that you have qualified for the promotional code you are trying to use. For example, some products are excluded from promotions or you have to spend a certain amount to qualify for a discount. Kent reserve the right to withdraw discount offer codes at any time.

Also please note that shipping costs are not included in any spend requirement for a promotion.
