TERMS AND CONDITIONS FOR CONSUMER SALES

PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

These terms and conditions of sale do not affect your statutory rights as a consumer.

Formation of the contract

1.1. These terms of sale apply to all goods supplied by GB Kent & Sons PLC, registered in England and Wales at London Road, Apsley, Hemel Hempstead, HP3 9SA, company number 00066471 and VAT number GB 238 7893 09 (“GB Kent”).

1.2. No contract exists between you and GB Kent for the sale of any goods until GB Kent has received and accepted your order and has sent you confirmation in writing or by email to the address or email address you have given. Once GB Kent does so, there is a binding legal contract between us. Please note that in addition to any other right GB Kent may have to decline your order, eg when the item is out of stock or otherwise unavailable, GB Kent may in its sole discretion, decline your order when it believes on reasonable grounds that you are a trader, or your purchase is likely to lead to infringement of GB Kent’s rights by, for example, the onward supply of our products to third parties outside the United Kingdom. 1.3. The contract is subject to your right of cancellation in certain cases (see below).

1.4. GB Kent may change these terms of sale without notice to you in relation to future sales.

1.5. Before placing your order, you will have the opportunity to review your order details, including the goods ordered, delivery address and payment information, and to correct any errors before submitting your order.

1.6. The contract between you and GB Kent will be concluded in English.

Description and price of the goods

2.1. The descriptions and current price of the goods you order will be as shown www.kentbrushes.com at the time you place your order.

2.2. The goods are subject to availability. If, on receipt of your order, the goods you have ordered are not available, GB Kent will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.3. Every effort is made to ensure that prices shown on www.kentbrushes.com are accurate at the time you place your order. If an error is found, GB Kent will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, GB Kent will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.4. In addition to the price of product/s, unless your purchase is exempt, you will be required to pay a delivery charge for the goods, as explained in the section of GB Kent’s website concerning delivery. Please see our shipping and delivery page www.kentbrushes.com/pages/shipping-and-delivery

2.5. Orders delivered within the United Kingdom will be priced inclusive of UK VAT (currently 20%). For orders shipped to the EU, the price of the goods and delivery charges will be inclusive of the local VAT where due. International orders shipped outside of the UK and EU, the price of the goods and delivery charges will be exclusive of VAT. EU and International orders may be subject to customs or import duties, additional tariffs and tax charges once they reach their destination. These charges will be automatically payable by the customer upon delivery. Please note that we have no control over these charges, and we cannot predict their amount. Please contact your local customs office for further information before placing your order. In the event of cancellation, you will be responsible for recovering any such charges.

2.6. Any amendments must be made by 1 pm the next working day. Amendments cannot be made once the package is in transit. You must notify GB Kent as soon as possible via email customerservice@kentbrushes.com. The parcel should be rejected upon delivery or returned unused in its original packaging. The refund will be issued upon return of the goods.

Payment

3.1. All prices are shown in sterling (GBP). If you are purchasing from our website, all payment transactions will be made in sterling (GBP). If your country's currency differs from this, your bank/credit card company may charge you an additional transaction fee and/or conversion fee. This fee is beyond our control, and you may need to contact your bank/card provider prior to purchase to confirm the fees.

3.2. Payment for the goods and delivery charges can be made by any method shown at www.kentbrushes.com at the time you place your order.

3.4. GB Kent & Sons Plc. may, in its sole discretion, decline your order when it believes on reasonable grounds that your shipping address is a freight forwarding address or storage company.

Delivery

4.1. The goods you order will be delivered to the delivery address you give when you place your order. Orders with freight forwarding and self-storage addresses will not be fulfilled and will be cancelled. Please see 3.4.

4.2. All orders placed via www.kentbrushes.com will be sent via Royal Mail tracked delivery. If delivery cannot be made to your address, Royal Mail will inform you as soon as possible by email or text and will leave a calling card at the address.

4.3. If delivery is not possible, you will be notified by Royal Mail or your local postal or courier service and be given the option to rearrange your delivery for an alternative delivery date or a place to collect the goods.

4.4. Every effort will be made to deliver the goods without undue delay, and in any event within 30 days of the date on which the contract is entered into. However, GB Kent will not be liable for any delay in delivery caused by circumstances beyond GB Kent’s reasonable control. If you have not received your order within 30 days, please contact us.

4.5. You will become the owner of the goods you ordered and responsible for the risk of loss or damage to them once they have been delivered to you.

Your right of cancellation

5.1. In certain cases, you have a right to cancel the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

5.2. You do not have the right to cancel the contract if the order is for the supply of certain goods, including goods that are made to your specifications or are clearly personalised, goods that are liable to deteriorate or expire rapidly and sealed goods not suitable for return for health protection or hygiene reasons.

5.3. GB Kent will inform you prior to the contract coming into force if you have a right of cancellation, and if so, the conditions, time limit and procedures for exercising it.

5.4. Where you have the right to cancel the contract, you must normally do so within 14 days after the goods come into your physical possession. Please note that due to hygiene reasons, your purchase(s) must be unused, returned in the original packaging and in a saleable condition. Upon return, all items are inspected by our customer services team before your refund is processed.

5.5. To exercise your right of cancellation, you must inform GB Kent by post or email, at the address or email address shown below, giving details of the goods ordered and, where appropriate, their delivery.

5.6. If you exercise your rights of cancellation after the goods have been delivered to you, you will have to bear the cost of returning the goods to GB Kent. The goods must be returned to the address shown in clause 5.5. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.

5.7. Once you have informed GB Kent that you are cancelling the contract, GB Kent will refund or re-credit you within 14 days for any sum that has been paid by you or debited from your credit card for the goods, subject to the goods being returned in accordance with clause 5.4 and passing inspection by our customer services team.

5.8. If you do not return the goods as required, GB Kent may charge you a sum not exceeding the direct costs of recovering the goods.

Returning goods

6.1. Customers are responsible for ensuring the safe return of the product(s). This includes securely packaging the item(s) to prevent damage in transit. The product remains the customer's responsibility until it arrives at the address provided for returns.

6.2. Due to hygiene reasons, all non-faulty returned items must be unused, in their original packaging, and in a saleable condition. Items that do not meet these criteria may not be eligible for a refund.

6.3. Upon receipt, all returned items will be inspected by our customer services team.

6.4. Refunds will only be processed once the item(s) have passed the inspection process. Please allow 7–10 working days for the refund to be completed.

6.5. Delivery charges are non-refundable unless the goods are faulty, misdelivered, where cancellation rights apply and a refund of standard delivery is required by law, or where we choose to issue a refund at our sole discretion.

6.6. Customers are responsible for the cost of international returns; we do not cover return shipping fees for orders sent from outside the United Kingdom.

Warranty

7.1. GB Kent’s warranty applies exclusively to products that have been purchased from the Kent Brushes Website, authorised Kent Brushes retailers or web-based vendors. The product must have been used and cared for in accordance with our manufacturer’s care instructions.

Please note this warranty does not apply to any faults in our products arising from fair wear and tear, damage by you, use otherwise than as recommended by us, failure to follow our care instructions or any alteration or repair carried out without our approval.

Data Protection

8.2. GB Kent will only use the information you provide about yourself for the purpose of fulfilling your order unless you agree otherwise. GB Kent would like to notify you of products and offers that may be of interest to you from time to time. If you would like to be notified, please tick the box at checkout or complete our newsletter sign-up form on www.kentbrushes.com. You can correct any information about you by editing your account details online or asking for information about you to be deleted by email or post. See contact details in section 5.5.

EU Right of Withdrawal

9.1. If you are a consumer in the European Union, you may have a statutory right to withdraw from your online purchase within 14 days of receiving your order, without giving a reason. You can complete the EU Right of Withdrawal form.

9.2. To exercise this right, you must tell us clearly that you wish to withdraw from the contract. You can do this using our online withdrawal form or by contacting us.

9.3. You are responsible for returning the goods to us without undue delay and no later than 14 days after telling us that you wish to withdraw. Unless the goods are faulty or we have agreed otherwise, you are responsible for the cost of returning the goods to us. We recommend using a tracked service.

9.4. You may inspect the goods as you would reasonably be able to do in a shop. However, you are responsible for any reduction in the value of the goods caused by handling them more than necessary to establish their nature, characteristics, and functioning.

9.5. For hygiene reasons, brushes and grooming products must not be used on hair, scalp, skin, body, beard, or with shaving soap, cream, or other products if you wish to return them under the right of withdrawal. Where a returned item shows signs of use, contamination, damage, or handling beyond what is necessary to inspect it, we may reduce the refund to reflect the loss in value. In some cases, where the item cannot be resold for hygiene reasons, this deduction may be up to the full price of the item.

9.6. Where a valid withdrawal applies, we will refund the price paid for the eligible goods and the standard delivery charge where required by law. We do not refund additional costs for premium, express, or upgraded delivery chosen by the customer.

9.7. This right does not apply to goods that are made to your specifications or clearly personalised, unless they are faulty.

Applicable Law

These terms of sale and the supply of the goods will be subject to English Law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.
